Syndicate Marketing, LLC (“Syndicate Marketing, LLC,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you interact with our website, marketing communications, lead-generation services, software platforms, telephone calls, SMS messages, email communications, and any related products or services (collectively, the “Services”).
This Privacy Policy applies to information collected from individuals located in the United States. By accessing the Services, providing information to us, consenting to receive communications, or otherwise engaging with us, you acknowledge that you have read and understood this Privacy Policy.
This Privacy Policy is incorporated into, and forms part of, our Terms and Conditions. Capitalized terms not defined here have the meanings set forth in the Terms and Conditions.
1. Information We Collect
We collect information from and about you in several ways:
1.1 Information You Provide Directly
When you complete a web form, landing page, application, survey, opt-in form, contact request, registration, or otherwise interact with us, you may provide:
- Identifying information such as your full name, postal address, city, state, ZIP code, country;
- Contact information such as your telephone number, mobile phone number, and email address;
- Demographic information such as age range, gender, occupation, household size, or income range (where voluntarily disclosed);
- Commercial information such as products, services, or categories of interest, prior purchases, and inquiries;
- Financial information such as credit score range, employment status, or income range, where you provide it in connection with a financial product inquiry;
- Health-related information only where you voluntarily disclose it in connection with a relevant service (such as insurance inquiries);
- Verbal information disclosed during telephone calls with our representatives;
- Any other information you choose to provide.
1.2 Information Collected Automatically
When you access our website or engage with our Services, we automatically collect certain information, including:
- Device and browser information such as IP address, device type, operating system, browser type and version, screen resolution, language settings;
- Usage information such as pages viewed, links clicked, time spent on pages, referring website, search queries, and date/time of access;
- Location information derived from IP address (approximate geolocation only; we do not collect precise GPS location without separate consent);
- Call metadata such as date, time, duration, originating number, terminating number, and disposition;
- Message metadata such as delivery status, opt-in and opt-out events, and engagement signals;
- Cookies, web beacons, pixels, server logs, and similar tracking technologies (see Section 5).
1.3 Information from Third Parties
We may receive information about you from:
- Lead generation partners, affiliates, marketers, and data providers who have obtained your consent to share your information with us and similarly situated parties;
- Publicly available sources such as government records, public directories, and business listings;
- Data appending and verification services that supplement information you have provided;
- Social media platforms, where you interact with our presence on those platforms;
- Our clients and business partners, where they engage us to communicate with their existing customers or leads;
- Service providers, including our communications platform providers (such as Twilio), analytics providers, and identity verification providers.
1.4 Call Recordings
Some, but not all, telephone calls between you and Syndicate Marketing, LLC may be recorded. The majority of our calls are not recorded. Where calls are recorded, you will be notified at the beginning of the call. Recordings, where created, are retained for seven (7) days from the date of the call and are then automatically and permanently deleted, except where applicable law, a legal hold, a pending dispute, or your specific written request requires a longer retention period.
2. How We Use Your Information
We use the information we collect for the following purposes:
- To provide, operate, maintain, and improve the Services;
- To send marketing and promotional communications via SMS, MMS, voice (including prerecorded or automated voice where consent permits), and email regarding our own products and services, those of our clients, and those of our partners, affiliates, and advertisers we reasonably believe may be of interest to you;
- To deliver transactional, informational, customer service, or relationship messages associated with services you have requested;
- To respond to your inquiries, requests, and feedback;
- To verify your identity, authenticate access, and prevent fraud or abuse;
- To match you with our clients, partners, or third-party advertisers whose products or services may be relevant to your interests;
- To personalize content, recommendations, and communications;
- To conduct analytics, research, market analysis, and product development;
- To audit interactions, ensure quality, and train personnel;
- To enforce our Terms and Conditions and other policies, and to protect the rights, safety, and property of Syndicate Marketing, LLC, our users, and others;
- To comply with applicable legal obligations, including responding to subpoenas, court orders, and other legal process, and to maintain records of consent as required under the Telephone Consumer Protection Act, the FTC Telemarketing Sales Rule, and applicable state laws;
- For any other purpose disclosed to you at the time of collection or for which you provide consent.
3. Legal Bases for Processing
Where applicable, we rely on the following legal bases for processing your personal information:
- Your consent, which you may withdraw at any time as described in this Privacy Policy and our Terms and Conditions;
- Performance of a contract or to take steps at your request prior to entering into a contract;
- Our legitimate business interests, such as operating, improving, and marketing our Services, preventing fraud, and ensuring the security of our systems, provided such interests are not overridden by your rights and interests;
- Compliance with legal obligations to which we are subject.
4. How We Share Your Information
We may share your personal information in the following circumstances:
4.1 Service Providers
We share information with third-party service providers who perform services on our behalf, including communications platform providers (such as Twilio), hosting and infrastructure providers, customer relationship management (CRM) platforms, email service providers, analytics providers, fraud-prevention providers, payment processors, professional advisors (legal, accounting, and consulting), and similar vendors. These service providers are bound by contractual obligations to use information only as necessary to provide services to us.
4.2 Marketing Partners, Clients, and Affiliates
We may share or sell your personal information with marketing partners, clients, affiliates, advertisers, and other third parties for marketing purposes consistent with the consent you have provided. This may include sharing your information with parties whose products or services we believe may be of interest to you, even if they were not specifically identified at the time of collection, subject to and to the extent permitted by applicable law.
4.3 Business Transfers
If Syndicate Marketing, LLC is involved in a merger, acquisition, financing, reorganization, bankruptcy, asset sale, or similar transaction, your information may be transferred or disclosed to a successor entity, prospective purchaser, or their advisors as part of due diligence or as an asset of the transaction. 4.5 With Your Consent or at Your Direction
We may share your information for any other purpose with your consent or at your direction.
4.6 Aggregated or De-Identified Information
We may share aggregated, anonymized, or de-identified information that cannot reasonably be used to identify you for any purpose, including research, analytics, and marketing.
5. Cookies, Tracking Technologies, and Online Advertising
We and our service providers use cookies, web beacons, pixels, local storage, server logs, and similar technologies (collectively, “Tracking Technologies”) to operate the Services, remember your preferences, analyze usage, and deliver targeted advertising.
Types of cookies and similar technologies we may use include strictly necessary cookies (required for basic functionality), performance and analytics cookies (which help us understand how the Services are used), functional cookies (which remember your preferences), and advertising and targeting cookies (which deliver relevant advertisements based on your interests).
Most browsers allow you to refuse or accept cookies and to delete cookies. Disabling cookies may limit your ability to use certain features of the Services. You may also opt out of certain third-party advertising practices by visiting the Network Advertising Initiative (www.networkadvertising.org), the Digital Advertising Alliance (www.aboutads.info), or for European users, www.youronlinechoices.eu.
Some browsers and devices support “Do Not Track” or “Global Privacy Control” signals. We will honor Global Privacy Control signals where required by applicable law (such as California, Colorado, and Connecticut) as a request to opt out of the sale or sharing of personal information.
6. Data Security
We implement administrative, technical, and physical safeguards designed to protect the personal information we collect from unauthorized access, use, alteration, or disclosure. These safeguards include access controls, encryption in transit, vendor management, and routine security review.
Despite these measures, no method of transmission over the internet or method of electronic storage is one hundred percent secure. We cannot guarantee absolute security. You are responsible for maintaining the confidentiality of any credentials and for promptly notifying us of any suspected unauthorized use.
7. Data Retention
We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including:
- Consent records: a minimum of five (5) years following the date of consent or last communication, as required by the FTC Telemarketing Sales Rule and applicable state laws;
- Opt-out records: retained indefinitely, or for as long as necessary to honor your opt-out request and to demonstrate compliance, consistent with FCC rules requiring records to be maintained for at least four (4) years;
- Call recordings (where created): seven (7) days, subject to legal hold or other lawful basis for longer retention;
- Communications metadata: as needed for service delivery, billing, troubleshooting, and compliance audits;
- Other personal information: as long as needed to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements.
When we no longer need personal information, we will delete, anonymize, or aggregate it, except where retention is required by law or for legitimate business purposes such as fraud prevention, defense of legal claims, or audit.
8. Your Rights and Choices
8.1 Opting Out of Marketing Communications
You may opt out of marketing communications from Syndicate Marketing, LLC at any time and free of charge by any reasonable method, including:
- Replying “STOP,” “END,” “QUIT,” “CANCEL,” “UNSUBSCRIBE,” “REVOKE,” or “OPT OUT” to any SMS message;
- Clicking the “unsubscribe” link in any marketing email;
- Verbally requesting removal during a phone call with our representative;
- Submitting a written request via email to our designated opt-out address;
- Submitting a request through any contact form or method we make available.
We will honor opt-out requests as soon as practicable and in no event later than ten (10) business days from receipt, in accordance with FCC regulations. You may continue to receive transactional or relationship messages necessary for services you have requested even after opting out of marketing communications.
8.2 Access, Correction, and Deletion
Subject to applicable law and verification of your identity, you may request to access, correct, update, or delete personal information we hold about you. To make such a request, contact us using the information in Section 13.
8.3 Account Information
You may update certain account information directly through the Services where available, or by contacting us.
9. U.S. State Privacy Rights
Residents of certain U.S. states have additional rights regarding their personal information.
9.1 California Residents (CCPA/CPRA)
Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA”), California residents have the following rights:
- Right to Know: Request information about the categories and specific pieces of personal information we have collected, the sources, the business or commercial purpose for collection, the categories of third parties with whom we share it, and the categories of personal information we have sold or shared in the preceding twelve (12) months;
- Right to Delete: Request deletion of personal information we have collected, subject to certain exceptions;
- Right to Correct: Request correction of inaccurate personal information;
- Right to Opt-Out of Sale or Sharing: Direct us not to “sell” or “share” your personal information as those terms are defined under the CCPA;
- Right to Limit Use of Sensitive Personal Information: Direct us to limit our use of sensitive personal information to certain purposes;
- Right to Non-Discrimination: Not be discriminated against for exercising your rights.
Categories of personal information we have collected in the preceding 12 months: identifiers (name, email, phone, IP address); commercial information; internet/network activity; geolocation (approximate); audio information (where calls are recorded); inferences drawn from the foregoing; and, where applicable, professional, employment, financial, or other limited sensitive information.
Categories of sources: directly from you; automatically through your use of the Services; from lead generation partners and data providers; from publicly available sources; and from our clients.
Business or commercial purposes for collection: providing and improving the Services; marketing and advertising; analytics; security and fraud prevention; legal compliance.
Categories of third parties to whom we disclose, sell, or share personal information: service providers; marketing partners, clients, affiliates, and advertisers; analytics providers; communications platform providers (such as Twilio); legal and regulatory authorities; successor entities in a business transfer.
FOR THE PURPOSES OF THE CCPA, WE MAY “SELL” OR “SHARE” YOUR PERSONAL INFORMATION WITH MARKETING PARTNERS, AFFILIATES, CLIENTS, AND ADVERTISERS. To opt out of the sale or sharing of your personal information, click any “Do Not Sell or Share My Personal Information” link we make available, submit a verified consumer request using the contact information below, or transmit a Global Privacy Control signal through your browser.
We do not knowingly sell or share the personal information of consumers under sixteen (16) years of age without affirmative authorization.
To submit a verifiable consumer request, contact us using the information in Section 13. You may also designate an authorized agent to act on your behalf, subject to verification. We will respond to verifiable consumer requests within forty-five (45) days, with an extension of up to forty-five (45) additional days where reasonably necessary.
9.2 Other State Privacy Laws
Residents of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Texas (TDPSA), Oregon (OCPA), and other states with comprehensive consumer privacy laws may have rights similar to those described above, including the rights to access, correct, delete, obtain a copy of, and opt out of targeted advertising, sale, or certain profiling of personal information. To exercise these rights, contact us using the information in Section 13. If we deny your request, you may have the right to appeal that decision.
Utah Residents: As a Utah-based company, we are subject to the Utah Consumer Privacy Act and applicable state telemarketing laws. Utah residents may exercise their rights as set forth in this Privacy Policy.
10. Children’s Privacy
The Services are not directed to, and we do not knowingly collect personal information from, children under the age of thirteen (13) (or sixteen (16) in jurisdictions where applicable). If we learn that we have inadvertently collected personal information from a child without verifiable parental consent, we will take steps to delete the information. If you believe we have collected information from a child, please contact us immediately.
11. International Users
The Services are operated from the United States and are intended for users located in the United States. If you access the Services from outside the United States, you acknowledge that your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction. By using the Services, you consent to such transfer.
12. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the “Last Updated” date at the top of this Privacy Policy and, where required by law, provide additional notice (such as a prominent website notice or direct communication). Your continued use of the Services after the effective date of any change constitutes your acceptance of the updated Privacy Policy.
